
The Bombay High Court denied bail to the 34-year-old accused, Amit Patil who has been accused of raping a minor who happens to be his business associate’s daughter. Justice Bharati Dangre denied bail to the accused after he claimed that the relationship was consensual. Justice Dangre stated that even if it is assumed that consent was given, such consent would not be valid under Section 376 of the IPC which does not recognise the consent given by a minor. The case was registered in Abhiruchi Police Station, Pune on the complaint of the 17 year old under sections 376, 354-D, 506 of the Indian Penal Code and provisions of Sections 3, 4, 11 and 12 of the Protection of Children from Sexual Offences Act, 2002. The Court considered the man’s age, his relationship to the girl’s family and his marriage and children as well before denying bail.
